1. Introduction & Acceptance

Welcome to Room Scholars. These Terms of Service ("Terms") govern your use of the Room Scholars website at roomscholars.com and all related services (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

Room Scholars is a student accommodation discovery and booking platform that connects international students with verified accommodation providers worldwide. We act as an intermediary between students and accommodation providers.

2. Definitions

  • "User" refers to any individual who accesses or uses the Platform, whether registered or not.
  • "Student" refers to a User seeking accommodation through our Platform.
  • "Accommodation Provider" refers to property owners, operators, or managers who list accommodation on our Platform.
  • "Booking" refers to a reservation or application made through the Platform for a specific accommodation.
  • "Application Fee" refers to the non-refundable fee charged to process an accommodation application.
  • "Enquiry" refers to a request for information about a specific property submitted through our Platform.

3. Eligibility

To use our Platform, you must:

  • Be at least 16 years of age.
  • Have the legal capacity to enter into binding agreements.
  • Provide accurate, current, and complete information during registration and booking.
  • Not use the Platform for any unlawful purpose or in violation of these Terms.

4. Account Registration

You may create an account to access enhanced features such as shortlisting properties, submitting bookings, and tracking your applications. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

5. Our Services

5.1 Platform Services

Room Scholars provides:

  • A searchable database of verified student accommodation listings across the UK, Australia, New Zealand, Canada, and Europe.
  • Detailed property information including room types, pricing, amenities, and availability.
  • Enquiry submission and direct communication with accommodation providers.
  • Online booking and application processing.
  • Personalized accommodation recommendations and expert advisory support.

5.2 Role as Intermediary

Room Scholars acts as an intermediary platform. We do not own, operate, or manage any accommodation listed on our Platform. The contractual relationship for the tenancy is between the Student and the Accommodation Provider. We facilitate the connection but are not a party to the tenancy agreement.

6. Bookings & Application Fees

6.1 Enquiries

Submitting an enquiry is free of charge. Our team will contact you within 15 minutes to assist with your accommodation search.

6.2 Bookings

When you submit a booking through our Platform, you are applying for accommodation with the relevant provider. Booking confirmation is subject to the Accommodation Provider's approval and may require additional documentation.

6.3 Application Fee (Instant Booking)

By paying the application fee to Room Scholars, you acknowledge and agree:

  • The application fee covers administrative processing, documentation review, coordination with accommodation providers, and reservation assistance.
  • The application fee is non-refundable once the application process has commenced, regardless of whether you decide not to proceed, your plans change, your visa is delayed or refused, you fail to submit required documents, or you make alternative arrangements.
  • The application fee does not guarantee accommodation availability or acceptance by the provider.

6.4 Pricing

All prices displayed on our Platform are provided by the Accommodation Providers and are subject to change without notice. Room Scholars makes every effort to ensure pricing accuracy but cannot guarantee that all displayed prices are current. The final price will be confirmed at the time of booking.

7. Cancellation & Refund Policy

  • Application fees paid through the Instant Booking feature are non-refundable.
  • Cancellation of confirmed bookings is subject to the individual Accommodation Provider's cancellation policy.
  • Room Scholars is not responsible for refunds related to tenancy agreements between Students and Accommodation Providers.
  • In exceptional circumstances (e.g., property closure, provider cancellation), Room Scholars will assist in finding alternative accommodation or facilitating a refund from the provider.

8. User Obligations

As a User, you agree to:

  • Provide truthful and accurate information in all forms and communications.
  • Not impersonate any person or entity or misrepresent your affiliation.
  • Not use the Platform to send spam, unsolicited messages, or engage in harassment.
  • Not attempt to gain unauthorized access to our systems or other users' accounts.
  • Not scrape, crawl, or use automated tools to extract data from our Platform without written permission.
  • Not post or transmit any content that is illegal, defamatory, obscene, or infringing on intellectual property rights.
  • Comply with all applicable local, national, and international laws.

9. Intellectual Property

All content on the Platform—including but not limited to text, images, logos, graphics, software, and design—is owned by Room Scholars or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.

10. Disclaimer of Warranties

Our Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that:

  • The Platform will be uninterrupted, error-free, or secure.
  • Property listings are accurate, complete, or up to date (this is the responsibility of Accommodation Providers).
  • Any accommodation will meet your specific expectations or requirements.

11. Limitation of Liability

To the maximum extent permitted by law, Room Scholars shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform, including but not limited to:

  • Loss of accommodation, financial loss, or missed opportunities.
  • Issues with accommodation quality, condition, or management.
  • Disputes between Students and Accommodation Providers.
  • Visa refusals, travel disruptions, or changes in personal circumstances.

Our total liability shall not exceed the amount you paid to Room Scholars in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Room Scholars, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your breach of these Terms, your use of the Platform, or your violation of any third-party rights.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on our Platform. Continued use after changes constitutes acceptance of the revised Terms.
